1. Binding Acceptance of Agreement
Welcome to the digital ecosystem provided by Beijing Tianji Haohai Culture Communication Co., Ltd. (hereinafter referred to as the "Company," "we," "us," or "our"). These Terms of Service constitute a legally binding agreement between you and the Company governing your access to and use of our mobile applications, games, websites, software, content, and all associated services (collectively, the "Service").
Except for certain types of disputes described in the arbitration section below, you agree that disputes between you and the Company will be resolved by binding, individual arbitration and you waive your right to participate in a class action lawsuit or class-wide arbitration.
By downloading, installing, or otherwise using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to every provision of this agreement, you are strictly prohibited from using the Service and must delete our software from all your devices immediately.
2. Eligibility, Registration, and Account Safety
The Service is intended for a general audience. You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to create an account or use the Service. If you are under the age of 18, you must have the explicit permission of a parent or legal guardian who agrees to be bound by these Terms on your behalf. We reserve the right to request proof of age at any time and may suspend accounts failing to provide such verification.
Certain features of the Service may require you to register for an account. You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@tianjihh.com if you suspect any unauthorized access or security breach. The Company will not be liable for any losses caused by any unauthorized use of your account.
The Company provides the Service on an "as is" basis. We reserve the right, in our sole discretion, to modify, update, suspend, or terminate the Service or any part thereof (including features, graphics, and virtual items) at any time without notice or liability. We do not guarantee that the Service will be available at all times or in all geographic locations.
3. Intellectual Property Rights and Ownership
The Company is the sole owner or authorized licensee of all rights, title, and interest in and to the Service. This includes, but is not limited to, all game titles, computer code, software architecture, algorithms, artwork, character designs, animations, musical compositions, sound effects, audio-visual effects, catchphrases, methods of operation, moral rights, and all documentation related to the Service.
Global IP Protection
Our proprietary content is protected by international copyright, trademark, patent, and trade secret laws. No part of our intellectual property may be used, copied, or distributed without our express written permission.
Limited Use License
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable limited license to access and use the Service for your personal, non-commercial entertainment purposes only.
4. Prohibited Conduct and System Integrity
To maintain a fair and safe environment for all users, the following activities are strictly prohibited and may result in permanent account termination and legal action:
- Exploitation and Cheating: Using cheats, exploits, automation software (bots), hacks, or any unauthorized third-party software designed to modify or interfere with the Service or gain an unfair advantage.
- Reverse Engineering: Attempting to copy, decompile, reverse engineer, disassemble, or derive the source code of the software or any part of the Service.
- Data Mining: Using any automated system, including robots or spiders, to scrape, harvest, or monitor data from our servers.
- Infrastructure Abuse: Engaging in activities that overburden our servers or disrupt the Service for other users, including DDoS attacks or spamming.
- Illegal Content: Uploading or transmitting any material that is unlawful, defamatory, harassing, abusive, threatening, harmful, or otherwise objectionable as determined by the Company.
5. Virtual Goods, Currency, and Billing
The Service may offer virtual, in-game currency ("Virtual Coins") or items for use within the apps. These Virtual Goods are licensed to you, not sold. You acknowledge that Virtual Goods have no real-world monetary value and do not constitute personal property. You are prohibited from trading, selling, or transferring Virtual Goods for "real world" money outside of the Service.
All financial transactions are processed securely through the Apple App Store or Google Play Store. You must comply with their respective terms of service and billing policies. We do not store or process your credit card information directly on our servers.
Subscription services automatically renew at the end of each billing cycle unless you disable the auto-renew feature in your platform's account settings at least 24 hours before the current period ends.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL PURCHASES OF VIRTUAL GOODS AND SUBSCRIPTIONS ARE FINAL AND NON-REFUNDABLE. Any refund requests must be directed to Apple or Google as the merchant of record.
6. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE FREE FROM BUGS, VIRUSES, OR INTERRUPTIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BEIJING TIANJI HAOHAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE (WHETHER INCURRED DIRECTLY OR INDIRECTLY), OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) ANY CONTENT OBTAINED FROM THE SERVICE.
7. Governing Law and Arbitration
These Terms and any action related thereto will be governed by the laws of the People's Republic of China without regard to its conflict of laws provisions. Any dispute arising from or related to this agreement shall be submitted to the exclusive jurisdiction of the competent courts in Beijing, China for final resolution.
If any part of these Terms is held to be invalid or unenforceable under local law, that part will be construed in a manner consistent with applicable law to reflect the original intentions, and the remaining portions will remain in full force and effect.
